A Federal High Court in Kaduna has issued an interim injunction against the Kaduna State Government from interfering in the properties being developed by an estate firm in the state.

Justice H.H. Shagari on Tuesday also directed that “status quo ante bellum be maintained between the parties pending the hearing and determination of the originating motion.”

An estate developer, Hall 7 Real Estate Limited had filed the suit against the Attorney General of Kaduna State, Governor of Kaduna State, and Kaduna Urban Planning and Development Authority (KASUPDA) over the plot to take over its properties lying at plots 292067 and 292070 measurings approximately 6,594.35cm2 and 22,314.40m2 described as No 28 Muhammadu Buhari Way (Waff Road), Kaduna, Kaduna State.

The firm in the processes filed before the court through its lawyer, Patrick Ikwueto (SAN), said despite paying the ground rent and other relevant fees as evidenced in the Treasury Revenue Receipt dated December 22, 2020, its rights were revoked through two separate letters dated October 5, 2022, entitled “Notice of Revocation/Withdrawal of Right of Occupancy over File Number KDL 292067” and “Notice of Revocation/Withdrawal of Right of Occupancy over File Number KDL 292070” for alleged “continued failure and contravention of covenanted terms and conditions of the Right of Occupancy to wit: Non-Payment of Statutory Ground Rent.”

The suit has been fixed for a hearing on March 15 for hearing.
