The Federal Capital Territory High Court, Apo, has admitted fresh exhibits in a ₦250 million construction dispute between Simitex Engineering Company Limited and Red Sapphire Nigeria Limited.
Justice Abubakar Baba Shani admitted the documents during the testimony of Ibrahim Tajudeen, principal witness for Simitex, who was led in evidence by counsel A.T. Abdulkareem.
Also joined in the suit, marked FCT/HCHC/CV/4160/2024, are the Minister of the FCT, the Director of Parks and Recreation, and the Director of Development Control.
Simitex claims it executed extra works on Plot 1772 AOI, Garki District better known as the Abuja Zoological Garden/Treasure Island but was not paid after the property was re-acquired by the defendants, despite initial approval.
During proceedings, the claimant tendered six photographs and a document identified by the witness. They were admitted as Exhibits G, G1–G5, while a Corporate Affairs Commission printout was admitted as Exhibit H. The Bill of Quantities was also confirmed as Exhibit I. Defence counsel, Promise Choko, did not object.
Justice Shani reserved a ruling on whether to admit previous processes from the Abuja Magistrate’s Court, which had earlier favoured Simitex. The case was adjourned to October 9, 2025, for further hearing and cross examination.
In its claims, Simitex is asking the court to:
Order the defendants to refund construction costs for three rooms built on the property.
Restrain Red Sapphire from using or renting the offices until payment is made.
Compel the defendants to jointly or individually pay an additional ₦25 million for the works.
